Terms of Service

These Terms of Service ("Terms") govern your use of DSPX, a dashboard that helps you manage your own online shop — research, listings, orders, finances and shipping. DSPX is operated by Peak Ventures LLC, a New Mexico limited liability company ("we", "us", "our"). By using DSPX, you agree to these Terms.
The service
DSPX lets you connect a marketplace shop you own (such as Etsy) and, with your authorization, connect the Pinterest and supplier data sources that power research and content generation. Actions that change your shop — such as publishing a listing, updating a price, or processing an order — are presented for your review and approval.
Eligibility & accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for your account credentials and for activity under your workspace.
- You must own, or be authorized to operate, the shop and accounts you connect.
Marketplace & API connections
You connect Etsy and Pinterest using their official authorization (OAuth). Your use of those services remains subject to their own terms, and you must comply with the Etsy API Terms of Use, the Pinterest Developer Guidelines, and each platform's seller and content policies. You may disconnect or revoke access at any time, which stops DSPX from accessing that account's data.
Your responsibilities
- You are responsible for following the rules and policies of the marketplaces and platforms you use.
- You are responsible for the accuracy and legality of the products, prices, and content you publish, including intellectual-property compliance.
- Market signals in DSPX (favorites, views, trend data and any estimates) are demand indicators, not guarantees of sales or income.
Acceptable use
Do not use DSPX for unlawful activity, to infringe others' rights, to misuse data obtained through connected APIs, or in a way that violates a connected platform's terms.
Plans & billing
DSPX may offer paid subscription plans. Where paid plans apply, fees, the billing cycle, included usage, and any overage charges will be presented before you subscribe; subscriptions are billed through our payment processor. Applicable taxes may be added. During the open beta, a limited workspace may be provided at no charge and beta features may change. Except where required by law, fees are non-refundable.
Intellectual property
DSPX and its design, text and software are the property of Peak Ventures LLC. Content you create or connect remains yours; you grant us the limited rights needed to operate the service for you.
Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free, or that market signals or estimates will be accurate.
Limitation of liability
To the maximum extent permitted by law, Peak Ventures LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, or data, arising from your use of the service, marketplace or platform changes, or third-party outages.
Termination
You may stop using DSPX and disconnect your accounts at any time. We may suspend or terminate access for violation of these Terms or of a connected platform's terms.
Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules.
Changes
We may update these Terms; we will revise the "Last updated" date above, and continued use after changes means you accept the updated Terms.
